Short of unplugging the computers and going back to mailing zines and tapes, there is nothing we can do to get back under the radar.
On a not entirely relevant note, I find it interesting that some people who did zines in the 70's have talked about how 80's secrecy was a big change from when they saw (often rather adult) Star Trek zines all over the place at the same conventions that had actors and producers and everybody else.
The biggest problem with the fear of lawsuits and repercussions for "stepping out of line", in my opinion, is that these fears often lead fans to try to police their own communities in harmful and counterproductive ways. People have done things in recent years like threaten to report zine sellers to TPTB, ignoring the fact that TPTB likely know about zines, likely don't care, and likely view zines and online fic in about the same way. The delusion that we are "safe" if only we do X leads to a lot of horrible behavior within fandom as well as fans avoiding activities that wouldn't really have gotten them in trouble and failing to adequately understand the dangers of others. Net increase to misery and misinformation; net decrease to creativity. Yuck.
